Legal Declaration

Hangzhou Zixing Technology Co., Ltd. (hereinafter referred to as "Zixing Technology") shall collect, use, store, and share your personal information strictly in accordance with this Policy and relevant laws and regulations, including the Cybersecurity Law of the People's Republic of China, the Personal Information Protection Law, and the Information Security Technology---Personal Information Security Specification. For matters not explicitly stipulated herein, the provisions of the aforementioned laws and regulations shall prevail.

Except where attributable to Zixing Technology's negligence or wrongdoing, you assume all risks arising from your use of Zixing Technology's services. Zixing Technology disclaims all liability for any personal injury, property damage, or third-party damages resulting from your own gross negligence, conduct, or acts of third parties. You shall pursue legal liability against the responsible party in accordance with the law.

II.

Zixing Technology will exercise commercially reasonable efforts to ensure the security of your data stored within its services. However, Zixing Technology cannot guarantee absolute protection against all potential breaches of your personal information. Zixing Technology shall in no event be liable for the deletion of or failure to store data within its services. You may back up relevant data at your discretion.

III.

Should you violate this Policy, Zixing Technology reserves the right to suspend or terminate the provision of all Services to you without prior notice. This includes refusing service, closing your account, removing or modifying content, canceling orders, and deleting any information deemed unlawful or false.

IV.

You acknowledge and agree that the personal information protection measures herein apply solely to Zixing Technology's software and related services. Once you leave Zixing Technology's ecosystem to access other websites, services, or resources, we have neither the ability nor the obligation to protect any personal information you submit outside Zixing Technology's services, regardless of whether such access occurs via links or guidance from Zixing Technology.

V.

You acknowledge and agree that factors such as force majeure or technical risks may interrupt the services. Zixing Technology shall not be held liable for obstacles, defects, delays, modifications, or data loss arising from the following:

  1. Force majeure events, including natural disasters, strikes, riots, wars, government actions, or judicial orders.
  2. Malfunctions in your or Zixing Technology's software, systems, or hardware preventing service access.
  3. Public service outages (e.g., power outages, communication network faults) or your own actions (e.g., improper operation, unauthorized use) or third-party actions (e.g., computer viruses, Trojan horses, malware, hacking, user errors).
  4. Routine or emergency maintenance, system/device failures, defects, network/data security issues, or technical risks, provided Zixing Technology has exercised due care.
  5. Display inaccuracies or delays on webpages due to objective factors like internet technology limitations. Zixing Technology will rectify such issues promptly upon discovery.
  6. Other circumstances beyond Zixing Technology's reasonable control or foresight.

VI.

Zixing Technology shall not be liable in the following cases, provided that such liability does not arise from its own gross negligence or intentional wrongdoing:

  1. Unauthorized disclosure resulting from your sharing of account credentials.
  2. Leakage, loss, theft, or tampering of personal data due to hacking, computer viruses, government restrictions, or other force majeure events disrupting normal operations.
  3. Personal data breaches or resulting legal disputes caused by third-party products/services related to Zixing Technology.

VII.

Zixing Technology shall be liable only for direct and actual damages caused by its own actions under applicable law. Liability for incidental, consequential or punitive damages is expressly excluded.

VIII. Intellectual Property

  1. Zixing Technology and its affiliates own all intellectual property rights (including copyrights, trademarks, patents, trade secrets) in the platform and all related content (text, images, audio, video, charts, UI/UX designs, data, or electronic documents). These rights are protected by laws of Mainland China and relevant international treaties.
  2. No content may be reproduced, modified, redistributed, or used for commercial purposes in any media without prior written consent. All materials may be retained solely for personal, non-commercial purposes.

IX. Miscellaneous

  1. Section headings are for convenience only and do not affect interpretation.
  2. If any clause is void or unenforceable, the remaining clauses remain valid.
  3. In the event of any discrepancy between the English and Chinese versions, the Chinese version shall prevail.
  4. Specific products/services may have separate privacy policies; such policies shall override this Policy where inconsistent.

X. Governing Law and Dispute Resolution

  1. This Policy is governed by the laws of Mainland China. Where laws are silent, international commercial practices apply.
  2. Disputes arising from or relating to Zixing Technology's services shall first be resolved through negotiation. If negotiation fails, either party may institute legal proceedings in the competent People's Court where the defendant is domiciled.
